Baycol Claims
A high number of Baycol claims have been made against pharmaceutical
company Bayer. Approved in 1997, Baycol was soon recalled by August
2001 after a high number of adverse event reports were made to
the company. What closely followed the Baycol recall was a high
number of Baycol claims made against the company for the death
and severe effects suffered.
Most of the Baycol claims thus far have alleged instances of
rhabdomyolysis. When the Baycol recall was announced, already
reports of 416 cases of rhabdomyolysis had been made, including
31 deaths that seemed to indicate Bayer would suffer a high number
of Baycol claims. Later it was found that even more deaths had
been suffered because of Baycol use, at over 100 Baycol related
deaths. Bayer commented in September 2003 that the company had
so far paid $477 million to settle out of court 1,342 Baycol claims.
Even though a recent class action status representing over 1,000
Baycol claims was denied because of the variability in the circumstances
surrounding the Baycol claims, the company still faces a high
degree of scrutiny. There are currently approximately 11,000 Baycol
claims pending. The company has responded to the high number of
Baycol claims still awaiting decision by stating it would continue
to evaluate each case to reach a fair decision.
The Baycol claims have left many people skeptical of other statin
drugs and especially newer statin drugs. The latest cholesterol
lowering drug was met with criticism when it was described by
a consumer advocacy group to be more dangerous than Baycol, which
has resulted in thousands and thousands of Baycol claims because
of its’ dangers.
